Terms of Service

We may update these Terms at any time. When we make changes, we will revise the "Last updated" date above. The current version posted here always governs, and your continued use of the Services means you accept it.

Please read these Terms of Service ("Terms") carefully. By downloading, accessing, or using the Cat Collector app (the "App") or the website at catcollector.app (together, the "Services"), you agree to be bound by these Terms. Cat Collector is produced by nftstory ltd., a company based in Quebec, Canada ("we", "us"). If you do not agree to these Terms, do not use the Services.

1. About Cat Collector

Cat Collector lets you photograph cats you encounter, turn them into trading cards, build a collection, and share cards so other people can collect them. The Services are provided for personal, non-commercial entertainment.

2. Eligibility

You must be at least 13 years old to use the Services. If you reside in Quebec and are under 14, you may use the Services only with the consent of your parent or guardian. If you are otherwise a minor in your jurisdiction, you may use the Services only with the involvement and permission of a parent or guardian. By using the Services, you represent that you meet these requirements.

3. Your Profile

When you first open the App, we create a profile for you that does not require traditional account credentials, with a username. You are responsible for activity that occurs under your profile on your device. Do not choose a username that is offensive, impersonates others, infringes anyone's rights, or violates these Terms.

4. User Content

"User Content" means the photos, cat names, usernames, and other content you submit through the Services.

• Your responsibility. You are solely responsible for your User Content. You represent that you have all rights necessary to submit it and that it does not violate any law or these Terms.
• What you may not submit. Do not submit content that: infringes intellectual property, privacy, or other rights; depicts identifiable people without their consent; contains private or sensitive information about others; is unlawful, harassing, hateful, sexually explicit, or harmful to animals; or depicts animal cruelty or abuse. Photograph only animals and public scenes you are lawfully allowed to capture.
• Public sharing. You understand that cards you create or share — including the photo, cat name, username, and any location you attach — may be made publicly available, viewable on the web, and collected by other users. Uploaded cat photos are stored with public-read access and may be accessible to anyone who has the image URL, even outside the App. Do not submit anything you want to keep private.
• Location warning. If you attach location to a card, the place where the cat was photographed (derived from approximate coordinates) will be publicly visible to anyone who views the card or its web link. This may reveal your location or movements. Do not attach location for cats found at or near private residences, schools, workplaces, or other sensitive places.
• License to us. You grant nftstory ltd. a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt (for example, to generate the card image and cropped sticker), publish, publicly display, and distribute your User Content for the purpose of operating, displaying, sharing, moderating, securing, and improving the Services. We will not use your User Content in external marketing materials without additional permission, except to display public cards as part of the Services. This license continues for content you have shared to the extent others have collected it or it remains in circulation.
• Other users' content. Cards and content created by other users belong to them or their respective owners. Collecting a card does not transfer ownership; it lets you view and keep that card within the Services.

5. Moderation, Reporting, and Blocking

Cat Collector includes user-generated content that can be shared publicly. The App provides tools to report User Content and other users for violations of these Terms or objectionable material. We review reports submitted through the App or by emailing support@catcollector.app and take action where appropriate, which may include removing or disabling the reported content, restricting or terminating the responsible profile, and other enforcement measures. We may use automated tools together with human review, but we do not guarantee that all objectionable content will be detected before it appears. You may also block other users to prevent further interaction with their content. We act on valid reports in a timely manner.

6. Acceptable Use

You agree not to: use the Services for any unlawful purpose; harass, abuse, or harm others; harm or harass animals in order to photograph them; trespass or violate others' privacy to capture content; attempt to access, scrape, disrupt, reverse engineer, or interfere with the Services or our servers; submit malware; or circumvent any security or rate-limiting measures.

7. Intellectual Property

The Services, including the App software, branding, designs, and all related materials (excluding User Content), are owned by nftstory ltd. or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose, subject to these Terms.

8. Copyright Complaints

If you believe User Content infringes your copyright, send a notice to support@catcollector.app with the information required by applicable law (for notices under the U.S. Digital Millennium Copyright Act: identification of the copyrighted work, identification and location of the allegedly infringing material, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement under penalty of perjury that the information is accurate and you are authorized to act). We respond to valid notices in accordance with applicable law and may remove allegedly infringing content and terminate repeat infringers.

9. Third-Party Services and Apple

The Services rely on third-party platforms and providers, including Apple (App Store and device services such as location and mapping) and our cloud hosting and storage providers. Your use of those services may be subject to their own terms and privacy practices, which we do not control.

The App is a "Licensed Application" as defined in the Apple Media Services Terms and Conditions. You acknowledge that Apple is not a party to these Terms and is not responsible for the App or its content, and that Apple has no obligation to provide maintenance or support for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. To the extent these Terms conflict with Apple's standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), Apple's terms govern with respect to your use of the App.

10. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, that any content will be accurate, or that cats or locations identified by the App will be correct. You use the Services, including any location features and any decision to approach animals or places, at your own risk and are responsible for your own safety.

11. Limitation of Liability

To the maximum extent permitted by law, nftstory ltd. and its directors, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising out of or related to your use of the Services. To the maximum extent permitted by law, our total liability for all claims relating to the Services will not exceed the greater of the amount you paid us for the Services in the twelve months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless nftstory ltd. and its directors, officers, employees, and affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising from (a) your use of the Services, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any law or third-party rights.

13. Changes, Suspension, and Termination

We may modify, suspend, or discontinue any part of the Services at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. You may stop using the Services at any time. Sections that by their nature should survive termination (such as User Content licenses for content already shared, disclaimers, limitations of liability, and indemnification) will survive.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, for example by updating the date above or posting a notice within the Services. Your continued use of the Services after changes take effect means you accept the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the Province of Quebec and the applicable laws of Canada, without regard to conflict-of-laws rules. You agree that the courts located in Montréal, Quebec will have exclusive jurisdiction over any dispute, except where applicable law gives you the right to bring proceedings elsewhere. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@catcollector.app. Nothing in this section limits any non-waivable consumer-protection or statutory rights you have in your jurisdiction.

16. General Provisions

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, reorganization, or sale of assets. These Terms are the entire agreement between you and nftstory ltd. concerning the Services.
